HealthMate Terms of Use
These Terms of Use ("Terms") govern your use of HealthMate, the app for iPhone and Apple Watch (the "Service"), provided by Ilia Vlasov, operating as "w4app" (sole trader), domiciled in Finland ("we", "us", "our").
By downloading or using HealthMate, you agree to these Terms. Our Privacy Policy explains how we handle personal data and is part of these Terms. If you don't agree, don't use HealthMate.
1. What HealthMate is
Plain summary: HealthMate is an AI wellness coach. You are talking to an AI, not a person. It is not a doctor and not a medical device.
HealthMate is a wellness app for food, training, sleep and recovery. It:
- works with Apple Health, with your permission;
- lets you log meals, workouts and other wellness data by text, photo or voice, and keep health documents in the app;
- gives AI-generated wellness suggestions, daily briefings, nutrition guidance and workout plans;
- has a Health Coach you can chat with by text or voice message. To answer you, it can ask the app for the records it needs, such as your recent sleep, activity, meals or documents;
- can talk to you, including during a workout, when it reacts to the sets you log, your heart rate and what you say. Its spoken replies use an AI-generated voice unless you choose the phone voice (Section 8);
- reads restaurant menus from a photo, a QR code or a file, suggests dishes, and finds the dishes you eat most often;
- sends a morning briefing and reminders, for example when a workout you planned has not started 20 minutes after its planned time.
You don't need an account. Your records are stored on your iPhone. AI features send the data they need to our AI providers, as the Privacy Policy explains.
HealthMate provides general wellness information. It is not a medical device, not a medical service and not a substitute for professional medical advice. See Section 5.
2. Who can use HealthMate
You must be at least 18 years old. By using HealthMate, you confirm that you are 18 or older and able to enter into a binding agreement. HealthMate asks for your age during setup and relies on your answer.
Use HealthMate for yourself, for personal and non-commercial purposes. Don't use it to provide medical care or advice to other people.
3. Your data and your device
Plain summary: your records live on your iPhone. If you delete them, we can't restore them.
- HealthMate stores your records on your iPhone. We don't keep a copy on our servers, so we can't restore data that is deleted or lost.
- You are responsible for your device, its passcode and its backups.
- You can delete your data at any time in Settings → Privacy & Data → Delete all data (see the Privacy Policy).
4. Licence and acceptable use
We grant you a personal, non-exclusive, non-transferable and revocable licence to use HealthMate on Apple devices you own or control, as permitted by these Terms and Apple's Usage Rules.
You must not:
- copy, modify, reverse engineer or decompile HealthMate, except where the law allows it or a licence in Section 9 gives you that right;
- get around fair-use limits, subscription checks or security measures, or access our servers other than through the app;
- use HealthMate in a way that breaks the law, harms others, or overloads or disrupts the Service;
- resell HealthMate or use it to build a competing product.
5. Health information — IMPORTANT
Plain summary: HealthMate gives general wellness information. Talk to a doctor about medical questions, and call emergency services in an emergency.
- HealthMate is not a medical device, does not give medical advice, and does not diagnose, treat, cure or prevent any disease.
- AI suggestions are general information. They can be wrong, incomplete or unsuitable for you.
- Always ask a doctor or another qualified healthcare professional about a medical condition, and before changing your medication, diet or exercise because of a health condition. Never ignore professional advice or delay seeking it because of something in HealthMate.
- If you are pregnant, have a chronic condition or are under medical treatment, talk to your healthcare provider before acting on any suggestion.
- HealthMate is not for emergencies and does not monitor you. It does not watch for health problems, raise alarms or contact anyone for you. During a workout, the coach uses your heart rate only to guide your training. If you think you may have a medical emergency, call your local emergency number (112 in the EU) right away.
- Train safely. Exercise carries a risk of injury. Choose weights and intensity you can handle, stop if you feel pain, dizziness, chest discomfort or shortness of breath, and stay aware of traffic and your surroundings when you listen to the coach outdoors. Reminders and workout plans are suggestions, not instructions you have to follow.
Health documents
You can upload medical documents, such as lab reports, to HealthMate. HealthMate stores them on your iPhone and uses AI to transcribe their contents, for example values, units and the reference ranges printed on the document. It adds diagnoses and medications that a document states to your profile only after you confirm each one. HealthMate uses your profile to tailor general wellness and lifestyle suggestions.
HealthMate does not interpret test results, diagnose conditions, assess urgency or recommend treatment, and it is not a medical device. Always discuss your results and any health decision with a qualified healthcare professional.
6. Subscription
Plain summary: HealthMate is free to download and needs a subscription to use. It starts with a 14-day free trial, then renews automatically until you cancel, and it has fair-use limits.
Plans. HealthMate is free to download, and its features need HealthMate Pro — there is no free tier. Pro is an auto-renewing subscription, monthly (product ID com.w4app.healthmate.pro_monthly) or yearly (product ID com.w4app.healthmate.pro_annual), subject to the fair-use limits below. Prices, including taxes, are shown in the app and on the App Store before you buy, and may differ by country.
Payment. Apple sells the subscription and processes payment under Apple's terms. Payment is charged to your Apple Account when you confirm the purchase or, if you start with a free trial, when the trial ends. We do not receive your payment details.
Free trial. New subscribers are offered a 14-day free trial. Its length is shown before you subscribe. Unless you cancel at least 24 hours before the trial ends, the subscription starts and you are charged.
Automatic renewal. The subscription renews at the end of each period unless you cancel at least 24 hours before the period ends.
Cancelling. You can cancel at any time in your Apple Account settings (on iPhone: Settings → your name → Subscriptions). Pro stays active until the end of the period you have paid for. Deleting the app or your data does not cancel a subscription.
Price changes. We may change Pro prices for future periods. Apple tells you before a price increase takes effect and asks for your consent where required. You can cancel before any change takes effect.
Refunds. Apple handles refunds, and any right of withdrawal, under Apple's terms. You can request a refund at https://reportaproblem.apple.com. Nothing in these Terms limits your rights under mandatory consumer law.
Family Sharing is not available for HealthMate Pro.
Fair-use limits. Pro is for one person's own use. To keep HealthMate reliable and affordable, it has fair-use limits set well above normal use. Currently, per rolling 24 hours, Pro includes: 200 chat messages to the coach and trainer, including during workouts; 60 minutes of voice conversation with the trainer; 15 minutes of spoken replies in the HealthMate voice; 50 analyses of meals, menus or gym equipment; and 200 other AI requests, such as dish suggestions, calorie targets and workout schedules. It also includes 30 health document analyses per rolling 30 days. Each workout has its own limit on coach answers, and messages unrelated to health and wellness are limited separately. When you reach a limit, the feature pauses or switches to a simpler mode until the period rolls over, for example the phone voice instead of the HealthMate voice, or text instead of voice.
Changes to Pro. We may change Pro features or fair-use limits for a valid reason, such as preventing abuse, changes in the cost of AI services or legal requirements. If a change significantly reduces what Pro includes, we'll tell you in the app at least 30 days before it takes effect, and you can cancel before then.
7. Your content
You keep ownership of what you add to HealthMate, such as logs, photos, voice recordings, documents and messages ("your content").
You allow us to process your content only as needed to provide HealthMate to you, including sending it to the service providers named in the Privacy Policy when you use AI features. We don't sell your content, use it for advertising or use it to train AI models.
Only add content you have the right to use, and don't add other people's health information without their permission.
8. AI-generated content
HealthMate uses AI models from third-party providers, currently OpenAI and xAI (see the Privacy Policy). AI output:
- can be inaccurate, incomplete or out of date, even when it sounds confident;
- is general wellness information, not medical advice (Section 5);
- includes estimates, such as nutrition values from a photo, that may differ from reality.
You decide whether to act on it.
You are talking to an AI. The coach, the trainer and the assistant in HealthMate are AI systems, not people, even when you give them a name. Their spoken replies use the HealthMate voice, a synthetic voice generated by AI (OpenAI), unless you choose the phone voice in Settings → Voice. It is not a recording of a real person.
Menus and allergies. Dishes and ingredients read from a menu, and dish suggestions that take your diet and allergies into account, are AI estimates. A menu can be incomplete or out of date, and the AI can miss an ingredient. If you have an allergy or intolerance, always check with the restaurant before you order.
9. Apple and other third-party services
- Apple. You get HealthMate through Apple's App Store. Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/) applies alongside these Terms. Apple is not a party to these Terms and is not responsible for HealthMate or its support. Apple Health, Apple Maps (used to find restaurants and gyms near you), speech recognition, the App Store and push notifications are subject to Apple's terms.
- AI providers. AI features depend on third-party providers. If a provider is unavailable, a feature may be slower, use a backup provider or be temporarily unavailable.
- Restaurant websites. When you open a menu from a QR code, HealthMate shows the restaurant's own website. That website belongs to someone else: we don't control or check its content, prices, availability or security, and its own terms and privacy policy apply. HealthMate opens only web links from a QR code and ignores other kinds of codes.
- Exercise illustrations. The exercise technique illustrations are by Everkinetic (Greg Priday and contributors, https://github.com/everkinetic/data). We use them unmodified, only scaled to fit the screen, under the Creative Commons Attribution-ShareAlike 4.0 International licence (https://creativecommons.org/licenses/by-sa/4.0/). The credits, with a link to a free copy of the same files, are in Settings → About → Third-party materials and behind each illustration's caption. Your rights in these illustrations come from that licence, and nothing in these Terms limits them.
We are not responsible for third-party services or websites themselves.
10. Changes to HealthMate
We improve HealthMate regularly and may add, change or remove features. AI features need an internet connection and may sometimes be unavailable. Briefings and reminders depend on iOS, your notification and Focus settings and your connection, so they can arrive late or not at all. Don't rely on them for anything time-critical. If we decide to stop offering HealthMate or HealthMate Pro, we'll tell you in the app at least 30 days in advance.
11. Disclaimers
To the extent the law allows, HealthMate is provided "as is" and "as available". We don't promise that it will be uninterrupted or error-free, or that AI output will be accurate or suitable for your circumstances.
Nothing in these Terms limits your rights under mandatory Finnish or EU consumer law, including your rights if the Service doesn't match what we promised.
12. Limitation of liability
To the extent the law allows:
- we are not liable for indirect or consequential losses, such as loss of data, profits or goodwill;
- our total liability for all claims relating to HealthMate is limited to the amount you paid for HealthMate in the 12 months before the event giving rise to the claim, or €100, whichever is greater.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, for intentional or grossly negligent conduct, or for any liability that cannot be limited under Finnish or EU law.
13. Ending the agreement
- You can stop using HealthMate at any time. To remove your data, use Delete all data before you delete the app. Cancel a Pro subscription separately in your Apple Account settings.
- We may suspend or end your access if you seriously or repeatedly break these Terms, misuse the Service, or if the law requires it. Where reasonable, we'll tell you first.
- Sections that by their nature should continue, such as Sections 11, 12 and 16, continue after the agreement ends.
14. Transfer of these Terms
We may transfer these Terms and HealthMate to another entity, for example a company we set up or a buyer of the business. The new provider takes over our obligations under these Terms, and we'll tell you in the app beforehand. You may not transfer these Terms to someone else.
15. Changes to these Terms
We may update these Terms, for example when HealthMate or the law changes. For significant changes, we'll tell you in the app at least 30 days before they take effect. If you don't agree, stop using HealthMate and cancel your subscription before then. If you keep using HealthMate after the changes take effect, the updated Terms apply.
16. Governing law and disputes
These Terms are governed by the laws of Finland. If you are a consumer living in the EU, you also keep the protection of the mandatory consumer laws of your country.
Please contact us first at ; most issues can be solved that way. If we can't agree:
- consumers in Finland can contact the Finnish Consumer Advisory Services and the Consumer Disputes Board (Kuluttajariitalautakunta, https://www.kuluttajariita.fi);
- consumers elsewhere in the EU can get free help from the European Consumer Centre network (in Finland: https://www.ecc.fi/en/);
- you can also go to court. If you are a consumer, you can bring a claim in the courts of your home country or of Finland.
17. General
These Terms, the Privacy Policy and Apple's Standard EULA are the whole agreement between you and us about HealthMate. If a part of these Terms is found invalid, the rest still applies.
